Maybe a good question SheriffBooth or other members that are attorneys.

 

I was looking at joining ClubWrx and noticed that you can win prizes that other members are not eligible to enter cool right, maybe not.

 

I have had to deal with this issue at the office and we had a presentation regarding legal promotions and a big takeaway way no purchase necessary. Once money is involved and or considerations, you enter the lottery mode and a boat load of things change. The well-developed definition of a lottery is any arrangement that includes three elements: a prize offered and won by chance in exchange for consideration paid by the participants.

 

 

Does offering prizes to only paying ClubWrx members make the promotion a lottery?

Agree. I want to dismiss is as "who cares", but its actually a legitimate question.

While I am an attorney, I am not verse in this particular area of the law. What I can say however is that running sweepstakes/lotteries/"chance" offerings is complex and rife with more legal implications/constraints than one would think.

Since I've been a clubwrx guy and never sniffed a prize I'd say no!





I'd also mention how amazing this site is, all the moderators and of course the founders who are not only fantastic human beings but something we should all aspire to be. They are both amazingly intelligent yet down to earth and approachable as well. People like to talk of Buffet, Gates, Jobs etc... No, the wrx dudes... those are the true champions of the modern world!

Every legitimate contest has a no purchase necessary option to join for free. Doesn't mean its easy or won't require a self addressed stamped envelope though

Interesting question. The answer typically depends on where it is held (the state law is applicable). Many states have different laws. If this is open nationally (which I presume this one is because it is open to all members from all states), then it is supposed to comply with all 50 states' laws.

The cost of membership is not a direct attribute of aforementioned "contests", rather, membership dues simply grant a user access to locked areas of GolfWRX ("the site"), merch/swag/trinkets, and heightened standing ("exclusivity") within the online community as established within.

By surrendering membership dues, the user is afforded these above benefits, and others, including the [i]eligibility[/i] to participate in [i]free[/i] contests as offered by the site. [i]Eligibility [/i]for ClubWRX contests is assumed in the cost of membership, and participation in such contests must be explicit and voluntary on the part of the member. Paid membership carries no implied, express, or automatic entry into any such contest/giveaway.

GolfWRX, under the facilitation of its private "ClubWRX" designation, reserves the right to hold contests and giveaways limited to an exclusive sect of site members, insofar as said contests and giveaways do not carry, in and of themselves, a required entry fee, monetary or otherwise.
