I thought this initially as well, but reading through the opinion again (and refreshing my memory on the CBA and Fed. Arbit. Act) it seems more and more clear to me that there was no real legal basis for Judge Berman's decision. Here is the direct quote: "the Commissioner shall, after consultation with the Executive Director of the NFLPA, appoint one or more designees to serve as hearing officers" and "Notwithstanding the foregoing, the Commissioner may serve as hearing officer in any appeal under Section 1(a)"[/size]

This shows a fundamental misunderstanding of both the law and Judge Berman's opinion. The FAA has no language requiring that an arbitration process be "fair." Furthermore there is no right to due process in arbitral proceedings, assuming the arbitration clause complies with the FAA (which is very broad and deferential). In fact, discovery can be wholly prohibited under the FAA.

The commissioner never consulted with the NFLPA about anyone not named Roger Goodell hearing the original case or ruling on it. And the judge rules on law, not the contract. But hey, Brady haters are gonna find a way to hate on him and the Pats. More probable than not is not precedent to do anything. Probable cause is not absolute proof. Keep hating on the guy that will be the GOAT when he retires though... Lol.

The problem with the Stillers is that with the exception of Harrison and Pouncey, there is zero veteran leadership in that locker room-

We all know about Pouncey and I believe that James is just old, tired and thinkin "WTF, I just gotta Stay healthy and collect a paycheck."

He had 4-5 guys at his back in the locker room-

And that was just on the defense-

[/quote]If the CBA had everything so locked down, how did this even end up in a federal court? There's a lot of talk going around about how Goodell had absolute power based on Article 46. I'm not a lawyer, but it seems to me that there must be something in courts that says, maybe Goodell can't have [i]that[/i] much power, otherwise this never would have gotten to this point. If Goodell had absolute power, the courts would have kicked this out.

Anyone can challenge a contract in court, but typically judges are loathe to mess with proper contracts. That's why the ruling is a problem because there is nothing that legally prohibits the CBA provisions. Judge Berman's entire ruling was based essentially on the NFL not following it's own policies, when it appears that they did in fact follow those policies. That is my exact argument...that the courts should have declined to hear the case, and why I'd put money on the NFL winning on appeal.

It was only a matter of time before Cris Carter did this to himself. They gave him enough microphone time that eventually his true character would come out.

The guy was a first rate piece of trash on and off the field for most of his entire playing career, and still is a jack wagon. Glad to hear him shove his foot down his throat.

49ers and anyone who cares to comment. Massive news out here with our man Jarryd Hayne making the roster in San Fran. From the press we get out here, I am expecting him to score a few touch downs, win a Super Bowl MVP and announce his candicy for President such is the impact he has "made".

It is a massive achievement to go from one sport to another at such an elite level, after seeing the photo a few pages earlier of his teammates, is he up to it, does he have different skills.

What's the prognosis at this stage.

Prob see him primarily on kick/punt return duty maybe some short yardage situations. While the raw skill set is there takes a while to learn all the other stuff like blitz pickups etc.

I'm glad he made the 53 certainly is a refreshing story coming out of SF for a change.

NFL football is officially back!

I am still the happiest person alive because of last years Super Bowl, so I can't be mad at the outcome this season for the Pats. Last years championship was the 2nd most meaningful championship for me, right behind the 04' Sox.

Another W for the Pats and another desperate excuse from the losing squad. I thought Tomlin and the Steelers were better than that...oh well, on to Buffalo.

I'm pretty sure the NFL is in charge of headsets at the games, not the home team, which really shouldn't surprised anybody based on how badly the NFL has handled anything recently.

It is funny though, I have seen on Twitter there are other reports now of people having "headset" or "communication" issues at Gillette. The Pats have a long rap sheet of crap, stuff like this keeps happening it will always be looked at the wrong way even if it was just faulty equipment. I read though too, that if one teams communications were down they were suppose to take the other teams down until it was resolved, and apparently that didn't happen quick enough.
