I think the issue is when both tours are running events at the same time, which is why I feel like the Tour should have tried to work with the PGL instead of dismissing them.

so how does the judge define irreparable harm?    Is it strictly money?  You  got millions, it doesn't matter for these playoffs on pga tour?   

 

  Or, well, the pathway to fame is majors and you need points for that to get in the majors for fame? Or winning this playoff event , (perhaps your one last time)?     Interesting when the liv lawyers called the fed ex playoffs the superbowl of golf...

Bottom line common sense. the liv players have not suffered any harm.  They chose to go play elsewhere for big $.

 

The judge nearly choked when she looked at the money list of the top players from LIV as compared to the PGA tour. Couldn't see it on the webinar but she laughed and said it is almost 50/50. 

 

The irreparable harm issue kills it for the LIV players

By being banned, the players aren't able to get seen on the PGA tour which is crucial for their sponsorship deals, which is where most of the better pro golfers make their money. Those players suing the PGA aren't upset about losing that 32nd place check from the Wyndham. They're upset that they can't get the screen time/course time to juice up those sponsorship checks.

I haven't had the time to read any of the pleadings, but generally "irreparable harm" in the context of injunctive relief or a temporary restraining order means "if you don't grant our temporary measure now, what we're seeking in the main lawsuit will become moot by the time the main lawsuit is resolved."

 

So basically, the LIV guys are saying that (1) they should be allowed to play in the FedEx playoffs, and (2) by the time their lawsuit winds its way through the court system, the FedEx playoffs will be over. The "irreparable harm" would come to the LIV guys in the sense that once those playoffs are over, they're over. If their main lawsuit succeeds, there's no way for them to go back in time and play in the FedEx Cup playoffs.

And LIV’s public relations rep lied or was lied to on up front money for some players taken out of tournament winnings. Did LIV not think this would come out when they sued?

Maybe they should not have left the tour then? That screen/course time was thanks to their PGA tour membership and their collective NIL being used to broker the current media deal.

 

Either way, speculative earnings don't really hold up well when the threshold is proving irreparable harm, as we see with the TRO being denied. Kind of a weird card to play when you have millions in guaranteed money in the bank

 

LIV locker room update, the guys are selecting who is going to "win" the next "tournament"

No chance they get OWGR points unless they change their format. The PGA Tour, Masters, R&A, and the DP Tour hate them.
