Question of Paypal chargeback

I think I am about to get screwed!
Well, after a beautiful drive to work this morning, I walk into my office with a fresh cup of coffee to log onto my computer. I open up my Outlook and there is an email from Paypal about a person requesting a chargeback from my account. A little surprised, so I log into Paypal, and there is a message from the resolution center that needs my attention. Anways here is the story:

The guy bought a wedge from me back on August 24th through Ebay. He did the BIN option and paid for the club not more that 5 minutes after purchasing. I shipped the club on August 26th and it was delivered August 28th. Well, now its November 13th and I receive a message that the charge was unauthorized and he is now requesting a chargeback for the purchase. No mention of returning the wedge 3 months after it was purchased, just that he wants his money back. So I sent Paypal an instant payment receipt, all copies of the ad that I had saved that showed him as the winner of the bidding, and proof of shipping and delivery to his confirmed address.

Am I missing something? Can a person just say that a charge was unauthorized, get their money back, and keep the product that I shipped to them? The address that I sent it to was confirmed through Paypal and he has a decent transaction history through them. I am just afraid that I am going to be out $50 and a really nice Cleveland wedge that is God knows where now.

Any suggestions?

In the past I would say you are good to go. But after some of the deals I have seen sellers have lately with both eBay and Paypal I'm not so sure anyone. Paypal could possibly bend you over on this transaction. For your sake I hope not, I am really getting sick on hearing about these kinda transactions going bad. The 'buyer is never wrong' stance that Paypal has been taking lately is getting tiresome.

 

Please let us know how this one turns out. A good friend of mine had a similar situation happen to him on a set of irons recently and he lost his money and his irons.

PayPal preaches sellers protection, but at the end of the day you'll end up getting shafted if the buyer request a charge back through his/her credit card company. I got shafted for the exact same reason you are right now 3 years ago for about $800 (I sold laptop on Ebay). Afterward when I was talking to PayPal on the phone I asked them this:

 

Me: So if I signup for paypal, buy a $1000 laptop and request a chargeback through my CC company, I'll get the laptop for free?

PayPal: I don't recommend you doing that.

Me: But I can, right?

PayPal: I won't comment on that.

Me: So how did you really protect me as a seller? I even faxed you guys a copy of his hand written signature that he received the laptop from FedEx.

PayPal: Well the CC company took the money back so we have to take it back from you.

 

I'll never use PayPal again.

A couple of things. Did the buyer leave you feedback on Ebay for the purchase?

 

If they have NOT left feedback then you are probabally going to get bent over.

Paypal's shi_ty policy is that the buyer has up to 90 days, for claims, chargebacks ect.

Since the buyer has refused to pay his or her credit card company for the purchase they are going to chargeback Paypal, and they are going to take the money from you. Paypal will always get thier money from one end or the other.

 

 

Paypal has no power with the credit card company. Your best avenue it to see if you can contact the credit card company directly and show proof of delivery, the Ebay account that was used, everything that you can. Then they hopefully will ask the buyer for proof that it was an unauthorized sale.

 

Then on the rare outside chance the credit card company might side with you, that this was an authorized purchase.

But that is a very very rare chance.

 

It possibly can be an unauthorized purchase on a hacked account. Keep that in mind also.

What I did to help prevent this type of thing is I have a PayPal account connected to a secondary banking account that I keep little to no funds in. I also have a PayPal debit card so that I can remove the funds from buyers after they pay me. If there is a legitimate charge back, then I can move the money into the small account or in this case, there are nu funds for PayPal to take from me.

this kind of crap makes me sick. i feel for you. do you have the buyers phone number? i dont know if its too late, but you could possibly still get the buyers personal info and call him about it. might be too late though. i dont know how many days you have to get that info after a sale. and yes, i would definitely take any $$$ you have in your PP acount out now. please keep us posted on this fiasco so we can all learn from this experience. i hope it turns out in your favor. thats just total BS...also curious if he left Feedback too.

Ebay has the option where you put in the item number and user id & you can get their phone number if they have one registered. Not sure where, but it is under your account somewhere. Had a guy try to pull this on me with a set of irons, so I called him. He kept telling me he didn't buy them, then when I presented the confirmation & tracking number that he received and signed for them, he magically remembered. Funny how that works.

Wow, I appreciate the encouragement. The issue is that if the money simply had to come from my CC then maybe I could argue with them a little more about it, however, I had $120 in the account so Paypal 'froze' $50 of it until a resolution is reached. Which, by the way, they said could take 75-100 days before anything is finalized.

Wow I can't believe how crappy paypal is getting to be I guess I will have to go in and retool my account this weekend to make sure this never happens. It is extremely sad because I have had nothing but positive experiences with them on issues I have encountered but it seems now that they have become a scammers best friend. cloudlx definitely use the search function and get the buyers number and good luck, hope all turns out in your favor on this transaction.

yeah, as soon as someone deposits money into my paypal account, i take it out immediately and leave just enough in there to cover the shipping costs of the item that was purchased. i cant believe after all the time that had passed from the sale until now that they would do this to the OP. they shouldve told the person who filed the claim to go pound sand cuz too much time had gone by. total BS. keep calling the jerk (call the buyer from different #'s and even *67 your # to block it sometimes until you reach him)

got it, thanks. that sucks so bad. here he is with a feedback rating of 3 (1 of which is yours) and he is already pulling this crap and ebay/paypal are letting him. i'd keep pestering him everyday on that phone to see what his problem is. i know its not a lot of money, but this kind of thing just grinds my gears. keep us posted

Forget calling him from different numbers. I'd just call him over and over again with IP Relay. Use AIM Express and go to town on this idiot.

Sorry to hear this, it is BS!

I do alot on highend guitar gear, this happens more than you think, though never to me (knock on wood BIGTIME!).

Stories Ihear from pals...

Sell exspensive guitar, doesn't matter on ebay or not. They do the chargeback, questioning fake, broke, etc. Many times after replying "got it, like it, etc". Paypal freezes their account, if no $ present, then withdraws $ from the linking checking/savings account on their PP account for transfers!

If it is not resolved (rarely is), the buyer returns item to PP, buyer gets their $ back, and you are w/o product for a long time, and many times might not get it back as it is PP's warehouse or whatnot forever. If oyu get it back, who wants a used or damaged item, etc.

 

Only good stories I've heard pertaining to it is if you do threaten PP with a lawyer, etc and can back it up, they will then and ONLY then listen to the seller.

Basically, buyer beware. Scares the heck out of me when dealing on big $ items.

Well, still haven't heard anything, didn't really expect to so soon. However, I did find a smoking gun of sorts. In any Ebay ad I ever post, I always say that if you have any questions or require additional pics to let me know and I will get them to you. Well, he emailed me about 2 hours before the purchase and asked some questions and ultimately requested additional pics of the wedge. I still have the email and sent it to Paypal. Hopefully this is enough to get this turned around. If this doesn't end up in my favor I will be severly disappointed. I gave them proof of purchase, proof of instant payment, proof of shipment, AND proof that he contacted me previous to the purchase. What else do they need to make this right!?

 

The punk part of this is that I NEVER have anything in my Paypal account. I sold a driver literally the day before this happened and hadn't gotten around to having a check sent to me. It was almost like he was waiting until there was something in the account before doing this. How would he know whether I had money in there or not is beyond me.
